Utilizing intellectual property to access the market: What should SMEs keep in mind?
For small and medium enterprises (SMEs), the correct application of intellectual property (IP) regulations from the beginning will help to avoid the costly legal issues of entering the EU market.


According to the National Office of Intellectual Property of Vietnam (Ministry of Science and Technology), not merely a tool to promote innovation, technology transfer, intellectual property (IP) is considered an increasingly valuable intangible asset for businesses, especially in the context of global trade with the current increase of interdependence in production and international trade.

From the TRIPS Agreement marking a milestone in associating IP rights with international trade to the trend of promoting IP protection in bilateral free trade agreements (FTAs), such as the Free Trade Agreement between Vietnam and the EU. (EVFTA), it can be seen that the relationship between IP rights and international trade becomes an inevitable and undeniable relationship.

With a big partner like the EU, taking advantages that IP brings through an FTA as well as understanding the rights and obligations of these intangible assets, businesses not only anticipate and avoid legal problems arise that can also maximize commercial advantages in their production and business activities.

As a new generation FTA, EVFTA is expected to become a new standard in the protection and enforcement of IP rights in global trade activities, so businesses in the course of their business activities. It is necessary to pay attention from the beginning to comply with IP regulations, especially in business relationships with partners with a long history of IP in the EU, thus creating a solid foundation of trust. Thus, expand opportunities for cooperation and investment in the context of a sustainable commercial relationship that is not only based on a wide range, but also needs to be penetrated as deeply today.
