Continue to coordinate actions to prevent infringement of intellectual property rights
Face with the complicated and prolonged Covid-19 epidemic, ministries and branches agreed on the coordination contents in 2021 of the Program to coordinate action to prevent infringement of intellectual property rights in the period III (referred to as Program 168 phase III) will focus on amending Laws and Decrees related to intellectual property, and reviewing and registering for protection of intellectual property rights for some agricultural products in some localities; training and capacity building for IP related subjects and handling violations.


In 2020, in the context of the complicated situation of Covid-19 epidemic, ministries and branches have been active in preventing and combating infringement of intellectual property rights (IP). With the aim of comprehensive, regular and timely coordination to improve the effectiveness and efficiency of IPR enforcement activities; building an IPR enforcement mechanism to meet the requirements of socio-economic development and international integration.

Program 168 Phase III continues to be signed and implemented according to Document No. 649 / CTHĐ / BKHCN-BVHTTDL-BNNPTNT-BCT-BCA-BTTTT-TANDTC-VKSNDTC on March 13, 2019, including 09 ministries: Science and Technology, Ministry of Culture, Sports and Tourism - Ministry of Agriculture and Rural Development, Ministry of Finance, Ministry of Industry and Trade, Ministry of Public Security, Ministry of Information and Communication, Supreme People's Court , People's Procuratorate of the Supreme. The Standing Committee of the Program was established in Decision No. 1958 / QD-BKHCN of the Minister of Science and Technology dated July 15, 2020 with the participation of 20 members.

Only in the IP field, by 2020, the functional forces of ministries and agencies have handled and resolved 1,460 IP rights infringements, of which 1,302 cases were handled by administrative measures and prosecuted, investigated and tried 158 cases with 269 suspects, the total fine was over 25 billion VND.   The IP rights enforcement forces confiscated and requested the removal of the infringing element and destroyed tens of thousands of infringing material evidences; request to change many business names, change domain information, return domain names and etc. Ministries and agencies (market management agencies, economic police, customs, specialized inspectors) have also coordinated handle many large-scale and complex cases.        

Currently, the program just stops at cooperation among 09 ministries and branches. Therefore, for Program 168 Phase III to be implemented effectively, it is very important to pay attention to the appropriate direction, orientation and resource allocation from the Government and ministries and sectors. At the same time, the member ministries and branches actively contribute ideas and implement Program 168  Phase III to be more effective.
